By accessing and using Alibi Secure ("Alibi," "we," "our," or "us"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

2. Description of Service

Alibi provides location verification, identity authentication, and encrypted record-keeping services through our mobile application. Our services include:

• Real-time GPS location tracking and logging
• FaceID/biometric identity verification
• Encrypted storage of location records and timestamps
• Emergency panic mode with automatic evidence capture
• Export and sharing of verifiable alibi records

3. User Eligibility

You must be at least 13 years old to use Alibi. By using our services, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will provide accurate and truthful information
• You will not use the service for illegal purposes

4. Account Registration

To use Alibi, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as necessary
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

5. Acceptable Use Policy

You May:

• Use Alibi for lawful personal protection and verification purposes
• Create and maintain records of your location and activities
• Share your records with authorized parties (legal representatives, law enforcement)
• Use panic mode in emergency situations

You May Not:

• Use Alibi to stalk, harass, or track others without their consent
• Falsify or manipulate location data or records
• Use the service for any illegal purpose
• Attempt to reverse engineer, hack, or compromise our systems
• Share your account credentials with others
• Use automated scripts or bots to access the service
• Violate any local, state, federal, or international laws

6. Location Data and Privacy

By using Alibi, you explicitly consent to:

• Continuous collection of your precise GPS location data
• Storage of timestamped location records
• Encryption and secure storage of your data
• Potential disclosure of records to law enforcement or courts when legally required

7. Panic Mode Terms

When you activate panic mode:

• Location, photos, videos, and audio may be automatically captured
• Emergency contacts will be notified immediately
• Records become permanently stored and cannot be deleted
• You authorize us to preserve evidence for potential legal proceedings
• False activation may result in account suspension

8. Evidence and Legal Use

Alibi records are designed to be admissible as evidence. By using our service, you understand that:

• Your location records may be used in legal proceedings
• We may be required to provide records in response to subpoenas or court orders
• Records are encrypted but not anonymous—your identity is linked to all data
• Admissibility of evidence is determined by courts, not by Alibi
• We make no guarantees about legal outcomes

9. Payment Terms

If you purchase a subscription:

• Subscriptions auto-renew unless canceled
• You authorize recurring charges to your payment method
• Prices are subject to change with 30 days notice
• Refunds are handled according to app store policies (Apple/Google)
• Cancellation does not delete your data unless you request deletion

10. Intellectual Property

All content, features, and functionality of Alibi are owned by Alibi Secure and are protected by copyright, trademark, and other laws. You may not:

• Copy, modify, or distribute our software or content
• Use our trademarks or branding without permission
• Reverse engineer or attempt to extract source code

11. Disclaimers and Limitations of Liability

Service "As Is"

Alibi is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Accuracy of location data
• Reliability of service availability
• Admissibility of records as evidence
• Protection from false accusations

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALIBI SECURE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of data, profits, or use of service
• Legal fees or costs related to use of our service
• Damages arising from service interruptions or errors
• Adverse legal outcomes despite using our service

Our total liability to you shall not exceed the amount you paid us in the past 12 months.

12. Indemnification

You agree to indemnify and hold harmless Alibi Secure, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the service
• Violation of these Terms
• Violation of any law or third-party rights
• Any content you submit or share through the service

13. Termination

We may suspend or terminate your account at any time if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• We are required to do so by law
• We discontinue the service

You may terminate your account at any time through the app settings. Upon termination:

• Your access to the service will cease
• We may retain records as required by law or legal proceedings
• No refunds will be provided for unused subscription time

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Arbitration Agreement

Any dispute arising from these Terms or your use of Alibi shall be resolved through binding arbitration rather than in court, except that:

• You may bring claims in small claims court if they qualify
• Either party may seek injunctive relief in court

By using Alibi, you waive your right to a jury trial and to participate in class action lawsuits.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the app
• Sending email notification
• Displaying a notice when you open the app

Continued use of Alibi after changes constitutes acceptance of the new Terms.

16. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Alibi Secure.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign these Terms without our consent. We may assign these Terms to any affiliate or successor.
